FBI Violates 1st Amendment And Assaults Citizen

Last week, David Warden, a former Police Officer, and currently of YouTube channel, News Now Houston -
https://www.youtube.com/channel/UC39jLNl2UpxDeYVYCToA56A - was legally filming the El Paso FBI field office building from a public sidewalk when he was physically detained and his camera seized. FBI Agents did not appear to have probable cause for a detainment. Mr. Warden subsequently complained of an injury to his left arm as a result of the physical contact by agents. David is part of a group of photographic journalist activists who specifically conduct “audits” for the purpose of testing whether law enforcement will respect individual’s rights to film public buildings from a public location. Mr.  Warden’s goal is not to illicit any response from law enforcement but to ‘verify’ an individual’s First Amendment rights are not violated. Given the negative response, there will likely be complaints filed (at minimum) against the FBI and special agent in charge (acting) Scott Brunner who was present during Mr. Warden’s detainment. Additionally, negative responses by officers such as this encounter, will generally result in additional activists visiting the same facility in greater numbers to conduct additional First Amendment Audits. As such, I highly recommend the El Paso Office review its procedures regarding individuals filming public buildings.

Refusal to be identified:
Texas Penal Code Section 38.02

1st Amendment right to Film:
Please refer to case Turner v. Driver, US 5th Circuit Court of Appeals ruling in February of 2018, which clarified that citizens to have the right under the first amendment to film law enforcement in the course of their duties.

Law Enforcement Procedures regarding individuals filming federal buildings:
May I direct your attention to US Department of Homeland Security Bulletin HQ-1B-012-2010 issued 08/02/2010 (attached) directed towards Federal Protective Services (FPS). While this bulletin is directed towards FPS/PSO’s, the guidance applies to any law enforcement agency in regards to an encounter with an individual taking pictures or video of any federal building.

Specifically:
“…Remember, that the public has a right to photograph the exterior of federal facilities from publicly accessible spaces such as streets, sidewalks…”
“Because the initial interview is voluntary, PSO’s should not seize the camera or its contents, and must be cautious not to give such “orders” to a photographer…. As this constitutes a seizure or detention.”

Lastly, I should note that none of the activists involved are Sovereign Citizens or dislike the police. To the contrary, they greatly respect the police, however they wish their rights were not violated simply for pulling out a camera and walking down the street.

THE BOTTOM LINE: Most of my readers know that I too have been illegally harassed and threatened by the FBI for simply writing the truth.  As in any illegal unconstitutional Federal organization without any oversight to speak of, they tend to get out of control even to the point of becoming the very description of crimes they claim to be protecting us from. Since the 1920’s the FBI has illegally become a Federal Police Department/Gestapo, instead of just an investigative department that it was intended to be.

The individual's name is David Worden, not Warden. He is not a former law enforcement officer. He was in the Air Force and his family owned a security company. He is a current and lifetime registered sex offender out of Texas, full name Earl David Worden. Mr. Worden used his family company's security guard vehicle and uniform to rape a young woman at gunpoint, and he has at least 2 other felony convictions. 3.4 seconds on Google will provide you with the truth about this rapist.
